Another U.S. Border Patrol Agent Charged With Murder

US Border Patrol agent Nicholas CorbettYesterday, Arizona Cochise County prosecutors charged U.S. Border Patrol agent Nicholas Corbet with murder in a case that shocked Mexico and the Mexican-American community in the USA.

Corbet shot a killed an undocumented immigrant in the desert between Douglas and Bisbee on January 12th, just 150 yards north of the US/Mexico border. The US Border Patrol agent murdered 22 year old Francisco Javier Dominguez-Rivera from Puebla, Mexico while he was kneeling according to three witnesses and a video in the possession of the Federal Bureau of Investigation (FBI).

The charges come after three months of investigations and after the Mexican government filed, including President Felipe Calderon, strong complaints with the US Departments of State and Justice. Nicholas Corbett was charged with four counts of homicide that include first-degree and second-degree murder, manslaughter and negligent homicide. Cochise County prosecutors are calling the shooting 'unjustified'. The prosecutors add, "Evidence shows that at the time he was shot, Mr. Dominguez-Rivera presented no threat to agent Corbett and agent Corbett did not act in reasonable apprehension of imminent death or serious physical injury."

The charges come after a series of murders of Mexican undocumented immigrants by border vigilantes and the imprisonment of two rogue US Border Patrol agents for the cowardly shooting, in the back, of Mexican citizen Osvaldo Aldrete-Davila and lying about it. There are also a number of killings of Mexican immigrants by the US Border Patrol that never received attention and that were not adequately investigated. One was the cowardly drowning in the Rio Grande (Rio Bravo) of three Mexican women attempting to cross near Eagle Pass, Texas on September of 2004.
